1. Acceptance of terms
These Terms of Service (“Terms”) form a binding agreement between you (“you”, “Customer”, or “user”) and MojaDesk, a customer support platform operated by The Site Weavers in the United Republic of Tanzania. By accessing or using MojaDesk (the “Services”), you agree to be bound by these Terms. If you do not agree, you must not use the Services.
These Terms are entered into in accordance with the Electronic Transactions Act, 2015 and other applicable laws of Tanzania, and electronic acceptance has the same legal effect as a handwritten signature.
2. Definitions
- “Services” means the MojaDesk website, applications, unified inbox, AI features, integrations, and related services.
- “Account” means the registered account you use to access the Services.
- “Customer Data” means data, messages, and content you or your end customers submit through the Services.
- “End Customer” means a person who contacts you through a channel connected to MojaDesk.
3. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Services. You are responsible for keeping your login credentials confidential and for all activity under your Account. You agree to provide accurate, current, and complete information and to notify us promptly of any unauthorised use of your Account.
4. Plans, fees, and payment
- Subscription plans and their features are described on our pricing page. Prices are stated in Tanzanian Shillings (TZS).
- Fees are payable in advance on a monthly or yearly basis through our payment partners (for example Pesapal) for automatic activation, or by bank transfer for manual activation.
- Applicable taxes, including Value Added Tax (VAT) as required under Tanzanian law, may be added to the fees.
- Unless otherwise stated or required by law, fees paid are non-refundable. Subscriptions renew at the end of each billing cycle unless cancelled beforehand.
- We may change our fees by giving you reasonable prior notice. Continued use after the change takes effect constitutes acceptance of the new fees.
5. Acceptable use
You agree not to use the Services to:
- Violate any law of Tanzania, including the Cybercrimes Act, 2015, or the rights of others;
- Send spam, unsolicited, fraudulent, or unlawful messages;
- Transmit malware, attempt to gain unauthorised access, or disrupt the Services;
- Upload content that is defamatory, obscene, hateful, or infringes intellectual property;
- Resell or provide the Services to third parties except as expressly permitted;
- Misuse AI features to deceive, harass, or harm others.
You are responsible for ensuring that your use of connected channels complies with the terms and policies of those channel providers (for example WhatsApp, Meta, and Telegram).
6. Your data and content
You retain ownership of your Customer Data. You grant us a limited licence to host, process, and transmit Customer Data solely to provide and improve the Services. You are responsible for obtaining all necessary consents from your End Customers and for the lawfulness of the data you process through the Services. Our handling of personal data is described in our Privacy Policy, prepared in line with the Personal Data Protection Act, 2022.
7. Third-party channels and services
The Services integrate with third-party platforms and providers. We are not responsible for the availability, accuracy, or policies of those third parties, and your use of them is subject to their own terms. Interruptions or changes by third-party providers may affect related features of the Services.
8. Intellectual property
The Services, including all software, design, trademarks, and content (excluding Customer Data), are owned by The Site Weavers or its licensors and are protected by Tanzanian and international intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law or with our written consent.
9. Service availability and support
We aim to keep the Services available and to provide support as described in your plan. However, the Services may occasionally be unavailable for maintenance, upgrades, or reasons beyond our control. We do not guarantee uninterrupted or error-free operation unless a separate service level agreement is in place.
10. Suspension and termination
You may cancel your subscription at any time through your account. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Services in a way that poses a legal or security risk. Upon termination, your right to use the Services ends, and we may delete Customer Data after a reasonable period unless retention is required by law.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet all your requirements or that AI-generated outputs will always be accurate.
12. Limitation of liability
To the maximum extent permitted by the laws of Tanzania, The Site Weavers shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill arising out of or related to your use of the Services. Our total aggregate liability arising out of these Terms shall not exceed the amount you paid to us for the Services in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Indemnity
You agree to indemnify and hold harmless The Site Weavers and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your Customer Data, or your unlawful use of the Services.
14. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. The parties shall first attempt to resolve any dispute amicably through good-faith negotiation. Where a dispute cannot be resolved, it shall be subject to the exclusive jurisdiction of the competent courts of Tanzania.
15. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and revise the “Effective date” above. Material changes will be communicated through the Services or by email where appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
